Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed on a Waitangirua rental property, all Healthy Homes compliance items must be completed within 90 days.

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on the Waitangirua rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to comply with all of the Healthy Homes Standards by the end of the anticipated timeframe could result in a fine of up to $7200. The person liable for this fine is the person who is named on the tenancy agreement as the person who is who is letting the property which could be the name of the landlord or the company that manages the property.

All the information on the Compliance Statement needs to be current before the tenancy agreement can be signed, and ideally it is updated during the entire tenancy, as necessary work related to it’s finished.

It’s crucial to remember that landlords who own multiple rental properties may face more severe penalties for not complying. The most severe penalties are given for serious breaches. Landlords with more than six properties could be fined up to $50,000 and as high as $100,000 in hearing claims.

Tenancies established between 1 July 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is compulsory to all Waitangirua and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included in any renewed, new or altered tenancy contract.
  • Property managers and landlords have to keep records that prove the compliance with each Healthy Homes Standard that apply or will be in force during the tenancy of an apartment rental.

From 1 July 2021

  • Private landlords and property managers must make sure their rental properties comply according to Healthy Homes Standard within 90 days of any newly renewed, extended or changed Tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) must adhere to the Healthy Homes Standard regardless of the time the tenancy began.

Starting 1 July 2023

  • All homes rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standard regardless of when the tenancy began.

Adequate heaters are crucial for healthy homes

Heating Waitangirua

Rental properties in Waitangirua should have a permanent source of heating that can warm the living area to at minimum 18degC, even on the coldest winter days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat requirements that it be permanently fixed (i.e., not portable), at least 1.5 kW in heating capacity and have the minimum requirement for heat capacity for the main living room. However, in some cases like small apartment buildings small apartments, a smaller electric fixed heater could be enough.

If the main living room already has a central heating source, like the heat pump, it could need some additional energy to make sure it meets the requirements. Certain kinds of heaters cannot be used to meet the quality since they’re either inefficient, unaffordable to operate and/or unsafe to run.
