Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed on a Waitangirua rental property, all Healthy Homes compliance work have to be finished inside of 90 days.

Since the 1st July of 2021, once a new, renewed or varied lease is entered into on the Waitangirua rental property, all Healthy Homes compliance work must be taken care of within 90 days.

The harshest penalties are handed down for the most serious violations, and landlords who own six or more properties can receive fines of up to $50,000, or as high as $100,000 in hearing claims.

Waitangirua Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is a requirement for all Waitangirua and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Landlords and property managers must keep records to demonstrate the conformance to each Healthy Homes Standard that apply or will be applicable to their rental properties.

Beginning 1 July 2021

  • Property managers and private landlords are required to ensure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of any new, renewed or varied tenancy.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) must adhere to the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2023

  • All households let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.
