Fines for Failing to Comply

As of 1st July 2021, if a new, renewed or varied tenancy is signed on a Takapuwahia rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Inability to adhere to one of the Healthy Homes Standards inside of the deadlines can result in an amount of $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t incorporated in a new, renewed or revised tenancy agreement, it could result in an additional fine or infringement fee.

Anyone can request information regarding the Healthy Homes Standard and how they relate to the building they live in. If the landlord or property manager is unable to provide the information requested within 21 days of being informed of the request, they could receive an infringement notice and be fined as high as $750.

In addition, there’s also a penalty of up to $900 for property owners or property managers providing a false or misleading Healthy Homes Compliance Statement or other information. The person who is responsible for this fine is whoever is named on the tenancy agreement as the one who is who is letting the property, so it could be the name of the landlord as well as the company that manages the property.

All the information on the Compliance Statement needs to be accurate before the tenancy agreement can be completed, and should be kept updated throughout the tenancy as any necessary work related to it’s finished.

It’s crucial to keep in mind that landlords with multiple rental properties may face more severe penalties for not complying. The harshest penalties are handed down only for serious violations. Those who have at least six rental properties could receive fines of up to $50,000, or as high as $100,000 in the case of hearing claims.

Healthy homes are important

Why is Healthy Homes Compliance So Important?

About 1 in 3 households homes in New Zealand and Takapuwahia, and research indicates that rental homes are likely to be colder, older and have less effective heating and have lower standard than those owned by owners.

Unreasonable Gaps & Holes

Draught Stopping Takapuwahia

Draughts are a major cause of dropping temperatures within houses. A cold home is more expensive to heat, resulting in wasted energy and increased bills.

If a draft can be perceived as a result of gaps or holes, it requirements to be closed.

What are the most unreasonable gaps or holes?

If you can feel external air getting in, or see the air is clear from a hole or gap or crack, then it is likely a crack or crack that needs sealing in somehow. Large gaps and cracks should be sealed permanently. Any gaps greater than 3mm that allow air in or out within the home require to be sealed. For instance, if an open fireplace isn’t in use it could cause draughts, and must be sealed off. Property managers and landlords are accountable for ensuring that these draughts are stopped whenever imaginable.

You don’t need to block up intentional gaps or holes which are part of the construction. For instance, small gaps around doors and windows may be required to allow for movement within the structure when the house gets warmer and cooler, in order to let them be opened and closed rather than securing. We will inspect all doors and windows as part of our Healthy Homes assessment of your rental property.

Adequate heaters are crucial for well-being houses

Heating Takapuwahia

Rental properties in Takapuwahia should have a permanent heating source which can warm the living room to at least 18 degrees Celsius, even on the coldest winter days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The heating source requirements for it to be permanent (i.e. not portable) with at least 1.5 kW of heating capacity and have the minimum required heating capacity for the main living space. A Heating Assessment Tool could be used to check if your current permanent heater(s) are adequate or if you’ll need to ‘top up’ with an additional heater. Unflued combustion and open fire heaters, such as portable LPG bottle heaters aren’t considered to be safe heating options for those following the Healthy Homes Standard.

If the heating you offer is electric heating or heat source, it must have the thermostat. This will help make your heating more consistent and efficient. In most homes, larger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters will be required. However, in some cases like small apartment buildings the smaller fixed electric heater may be sufficient.

If the main living room already has a fixed heating source like a heat pump, then it might require an update in order to comply with the standards. Certain kinds of heaters cannot be used to meet the quality since they’re either costly, not affordable to run, and/or unhealthy to run.

Ventilation Takapuwahia

Each liveable space in a rental house must include at least one open door or window to offer natural airflow. Furthermore, moist areas such as kitchens and bathrooms should have an venting fan outside to take moisture away.

It is the ventilation quality is all about understanding that dry air is less difficult to heat, and that an apartment that is well-ventilated is less likely to be a victim of damp and mould.

Bedrooms, living spaces, kitchens and dining rooms are considered liveable areas. Connecting spaces such as the hallway aren’t liveable , and thus do not need an opening door or window.

Each window, door , or Skylight requirements to have the ability to open to the outside and remain fixed in an open position, allowing the circulation of fresh air and ventilation.

All bathrooms and kitchens and any other room in your home with a bath, shower, cooktop or other high water-generating appliance will require suitable extractor fans that vent towards the outside. This Healthy Homes Assessment service will ensure that there is sufficient ventilation throughout the living spaces, including suitable extractor fans in areas with high moisture.

Insulation Takapuwahia

The insulation of the ceiling and underfloor is a requirement in all rental houses from 1 July 2019. All landlords and property managers must ensure that the insulation is in line with the new standard. In certain situations, the an existing insulation on the ceiling or in the subfloor space may need to be added or replaced.

A well-insulated house can reduce condensation and lower the chance of dampness and mould, and it will make it easier to the household to keep heat.

Insulation needs to meet the R-values for your area

The "R" signifies thermal resistance and is a measure of how well insulation withstands heat flow. The greater the R-value, the more effective the insulation.

  • Zone 1 - Auckland & Northland - ceiling R 2.9 and underfloor R 1.3
  • Zone 2 – the remainder of North Island except Taupo and the Central Plateau – ceiling R 2.9 underfloor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3 below floor R 1.3

Takapuwahia Moisture Ingress & Drainage

Keeping your rental property safe from dampness isn’t just about what’s inside the building but you must ensure there is somewhere to allow surface, rain as well as groundwater to move, and stop it from coming into the building. When it concerns damp and moisture it’s often those things that you aren’t aware of that can cause a lot of trouble, causing damage to your investment as well as affecting the tenant’s well-being.

Properties that are rented must be equipped with efficient drainage to remove floodwaters, surface water, and ground water. This includes an appropriate runoff or outfall. Making sure that the water is able to go, and also that it can’t linger underneath the buildings is an essential part of making sure your property is dry.

In addition to a drainage system to prevent moisture from entering, if your rental is enclosed between your flooring and ground, a ground moisture barrier must be constructed if it is reasonably practicable to do so.

The ground-moisture barrier generally a sheet of polythene that is placed over the ground, to block any moisture from the ground from accumulating into the property. It also helps in preventing from causing damage to the flooring insulation.
