Fines for Failing to Comply
From the 1st of July in 2021, once a new or renewed contract is signed on a Pauatahanui rental property, all Healthy Homes compliance work have to be done by the end of 90 days.

Failure to meet any of the Healthy Homes Standards inside of the period of time expected can lead to the possibility of a fine up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy agreement it could result in an additional fine or infringement fee.
Every tenant is entitled to request details regarding the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or property manager is unable to provide the necessary information within 21 days from being informed of the request, they can receive an infringement letter and be fined as high as $750.
In addition, there is also a penalty of up to $900 for property owners or property managers who have provided a false or misleading Healthy Homes Compliance Statement or other information. The person who is responsible for this fine is the person who is named on the lease contract as the person renting the property which could be the name of the landlord, or the property management company.
All the information on the Compliance Statement needs to be up-to-date before the tenancy agreement can be executed, and it should be kept updated throughout the tenancy as any relevant work gets completed.
It is important to keep in mind that landlords who have multiple rental properties may receive greater penalties for non-compliance. The harshest penalties are reserved for the most serious breaches, and landlords with at least six rental properties could be fined as high as $50,000 and as high as $100,000 in hearings.
