Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on a Pauatahanui rental property, all Healthy Homes compliance work need to be finished by the end of 90 days.

As of 1st July 2021, if a new or renewed lease is entered into on a Pauatahanui rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to meet one of the Healthy Homes Standards inside of the period of time expected can lead to penalties of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not incorporated within the renewal, new or amended tenancy agreement there could be an additional fine or infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the building they live in. If the property manager is unable to provide the necessary information within 21 days of getting the notice, the tenant could receive an infringement notice and could be fined up to $750.

In addition, there is also a fine of approximately $900 for landlords and property managers who have provided a false or false Healthy Homes Statement of Compliance or information. The person who is responsible for this fine is the one who is listed on the tenancy agreement as the person who is who is letting the property and it could be the landlord’s name or the company that manages the property.

The information contained in the Compliance Statement needs to be correct before the tenancy agreement can be signed. It should be maintained throughout the tenancy as any related work is completed.

It’s crucial to be aware that a landlord who manage multiple rental properties may receive even higher fines for non-compliance. The most severe penalties are handed down for serious violations, and landlords who own more than six properties could receive fines of up to $50,000, and as much as $100,000 in hearing claims.

Pauatahanui Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is required throughout Pauatahanui and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any renewed, new or varied tenancy agreement.
  • Property managers and landlords have to keep records of their the compliance with each Healthy Homes Standards that apply or will be in force during the tenure of their rental properties.

Beginning 1 July 2021

  • Private landlords and property managers are required to make sure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of any new, renewed or varied Tenancy.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) are required to comply with Healthy Homes Standard regardless of the time the tenancy began.

From July 1st 2023

  • All households that are rented out from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of when the tenancy began.

Heating Pauatahanui

Rental properties in Pauatahanui need to have a stable heating source that is able to heat the principal or the biggest living space to a minimum of 18 degrees Celsius, even on the coldest days of the year.
