Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed tenancy is signed for a Pauatahanui rental property, all Healthy Homes compliance items need to be done inside of 90 days.

It’s also crucial to keep in mind that a landlord who own multiple rental properties could face additional fines for non-compliance. The harshest penalties are reserved for the most serious violations. Those who have six or more properties could be fined up to $50,000, and even as high as $100,000 in hearing claims.

Pauatahanui Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is a requirement in all Pauatahanui and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included in any renewal, new or varied tenancy agreement.
  • Property managers and landlords must keep records that prove compliance with all Healthy Homes Standard that apply or will be in force to an apartment rental.

From 1 July 2021

  • Property managers and private landlords should make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of a renewal, new or a change in lease.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

From July 1st 2023

  • All houses rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.
