Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied contract is signed on a Pauatahanui rental property, all Healthy Homes compliance items must be completed inside of 90 days.

Since the 1st July of 2021, when a new or renewed lease is entered into on a Pauatahanui rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to adhere to any of the Healthy Homes Standards within the anticipated timeframe could result in the possibility of a fine up to $7200. All information in the Statement of Compliance needs to be accurate at the time that the tenancy agreement is completed, and should be kept updated during the entire tenancy, as relevant work gets completed.

It’s crucial to be aware that landlords with multiple rental properties could face greater penalties for non-compliance. The harshest penalties are reserved for the most serious violations. Those who have at least six rental properties could receive fines of up to $50,000, and as much as $100,000 for hearing claims.

Pauatahanui Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is a requirement throughout Pauatahanui and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records of their compliance with the Healthy Homes Standard that apply or will be in force throughout the tenancy period of their rental properties.

From July 1st 2021

  • Property managers and private landlords have to ensure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of a newly renewed, extended or changed tenant.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) are required to comply with Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All homes which are rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of when the tenancy first began.

Heating Pauatahanui

Rental properties in Pauatahanui need to have a stable heating source that can warm the largest or main living space to at least 18degC even on the most coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

If your living space already has a fixed heating source like an air conditioner, it could require some additional energy in order to comply with the standards. Certain types of heaters cannot be used to comply with the quality since they’re either expensive, inefficient and/or unhealthy to run.

Ventilation Pauatahanui
