Healthy Homes Assessment Services

Did you have any idea that the Healthy Homes Standards came into effect on the 1st of July 2021? Landlords now have to ensure their Paremata rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy, and all private rentals are required to be completely conforming by the 1st July 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, if a new, renewed or varied contract is signed on a Paremata rental property, all Healthy Homes compliance items need to be done by the end of 90 days.

From the 1st of July in 2021, once a new or renewed Tenancy is signed for the Paremata rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to meet each of Healthy Homes Standards within the period of time expected can lead to an amount of $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t incorporated in a new, renewed or revised tenancy agreement, there may be additional penalties or an infringement fee.

Anyone can request information regarding the Healthy Homes Standard and how they are related to the house they are living in. If the landlord or property manager is unable to provide the information requested within 21 days from getting the notice, the tenant will be issued an infringement notice and be fined up to $750.

Additionally, there is also a fine of as much as $900 for landlords or property managers providing a false or incorrect Healthy Homes Compliance Statement or other information. The person who is responsible for this fine is the person who is identified on the tenancy agreement as the one who is letting the property out which could be the name of the landlord as well as the property management company.

All information in the Statement of Compliance needs to be correct when the tenancy agreement is completed, and should be kept updated throughout the tenancy as any relevant work gets completed.

It is also important to remember that a landlord who own several rental properties can face additional fines for non-compliance. The most severe penalties are given only for serious breaches, and landlords with six or more properties can be penalised up to $50,000, and even as high as $100,000 for hearing claims.

Paremata Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is compulsory for all Paremata and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement should be included with any renewal, new or varied tenancy agreement.
  • Property managers and landlords have to keep records that prove the conformance to any Healthy Homes Standard that apply or will apply throughout the tenancy period of an apartment rental.

Beginning 1 July 2021

  • Property managers and private landlords should make sure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of a new, renewed or varied lease.
  • All boarder households (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All homes which are rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draught Stopping Paremata

Draughts are a major cause of less temperature in homes. A humid home is more expensive to heat, which results in wasting energy and incurring higher costs.

If a draught could be noticed from gaps that are not adequate or holes, it needs to be closed.

What are unreasonable gaps or holes?

If you can feel external air flowing in or the air is clear from a hole or gap that is, it’s likely a crack or hole that needs sealing in the way you can. Large cracks and gaps should be fixed permanently. Gaps greater than 3mm that let air in or out within your house require the sealing. For instance, if an open fireplace isn’t being used, it can cause draughts and should be blocked from. Property managers and landlords are responsible for making sure that draughts from the fireplace are removed whenever imaginable.

There is no require to block off gaps or holes in the building. For instance, small gaps around windows and doors could be necessary to allow for movement of the structure as the household heats and cools, in order to let them be shut and opened, rather instead of being stuck. Adequate heaters are important for healthy houses

Heating Paremata

Rental properties in Paremata should have a permanent heating source that can heat the living space to at least 18degC, even on the coldest winter days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heat requirements to remain fixed (i.e., not portable), at least 1.5 Kilowatts in heating capacity and have the minimum heating capacity needed in the living area. A Heating Assessment Tool can be used to check if your current installed heater(s) are sufficient or whether you will need to "top-up" with an additional heater. Fires that are open and unflued heaters like the portable LPG bottle heaters are not considered acceptable heating options for Healthy Homes Standard. Healthy Homes Standard.

If the heating system you offer is an electric heater or heat pump, then it must have a thermostat. This will make the heating more uniform and effective. For most houses, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters will be required. However, in certain instances like apartments with small spaces an electric, fixed heater could be enough.

If the main living room is already equipped with a fixed heating source, such as the heat pump, it might require an update to meet the standards. Some types of heaters can’t be used to achieve the standard as they are either costly, not affordable to run, and/or unsafe to run.

Ventilation Paremata

Each living space within a rental property must have at least one opening doors or windows to offer natural airflow. In addition, humid areas such as kitchens or bathrooms need to have an externally vented extractor fan that can take moisture away.

A ventilation standard is about recognising that dry air is much easier to heat and that the property that is properly ventilated is less likely to grow damp and mould.

Bedrooms, living spaces, kitchens and dining rooms are considered liveable areas. Connecting spaces such as the hallway are not considered liveable and are not need an opening window or door.

Each window, door , or the skylight needs at least to open to the outside, and stay closed, allowing to circulate fresh air as well as air flow.

All bathrooms and kitchens and any other area in your home with a bath, shower, cooktop or other high moisture-producing item will need adequate extractor fans that are vented to the outdoors. Insulation Paremata

Insulation for underfloor and ceilings is a requirement for all rent homes since July 1, 2019. All landlords and property managers have to ensure that the insulation meets this new quality. In some cases, an existing insulation on the ceiling or in the sub floor space may need to be filled with or replaced.

A properly insulated home will reduce the risk of condensation and lessen the likelihood of mould and dampness, as well as making much easier to the house to hold heat.

Rental properties need to have efficient drainage to remove rainwater, storm water and groundwater, with an appropriate runoff or outfall. Making sure the water is able to go and that it can’t linger underneath the structures is a crucial aspect of keeping your property dry.

Alongside the drainage system that will prevent moisture from entering, if your rental has an enclosed gap between floorboards and ground, a ground water barrier must be installed if it’s reasonably practicable to install it.

Ground moisture barriers are generally made of polythene and is laid on top of the ground, to block any moisture in the ground from rising into the home. It also helps in preventing any damage to your underfloor insulation.
