Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied tenancy is signed on a Papakowhai rental property, all Healthy Homes compliance tasks have to be finished by the end of 90 days.

Beginning on July 1st, 2021, when a new or renewed contract is signed on a Papakowhai rental property, all Healthy Homes compliance work must be taken care of within 90 days.

It’s crucial to remember that landlords who manage multiple rental properties may receive more severe penalties for not complying. The highest penalties are handed down for serious violations. Those who have six or more properties could receive fines of up to $50,000, and even as high as $100,000 in hearing claims.

Papakowhai Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is required throughout Papakowhai and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included with any renewed, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records that prove conformance with any Healthy Homes Standards that apply or will apply to your rental home.

Beginning 1 July 2021

  • Property managers and private landlords should make sure their rental properties comply with the Healthy Homes Standards within 90 days of any renewal, new or a change in tenant.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

From 1 July 2023

  • All houses let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.
