Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed for a Hongoeka rental property, all Healthy Homes compliance tasks need to be finished by the end of 90 days.

Beginning on July 1st, 2021, when a brand new or renewed Tenancy is signed for the Hongoeka rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to meet one of the Healthy Homes Standards within the period of time expected can lead to a fine of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t incorporated in the renewal, new or revised tenancy agreement, it could result in an additional penalty or infringement fee.

Any tenant can ask for details about the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or the property manager doesn’t supply the necessary information within 21 days of having received the inquiry, they could be issued an infringement notice and be fined upto $750.

In addition, there’s also a penalty as much as $900 for property owners or property managers who offer a false or incorrect Healthy Homes Statement of Compliance or other information. The person who is responsible to pay this fine is the one who is identified on the tenancy agreement as being the person letting the property out and it could be the landlord’s name or the property management company.

All the information on the Statement of Compliance needs to be current when the tenancy contract is signed. It must be updated during the entire tenancy, as necessary work related to it’s finished.

It is also important to note that landlords who own several rental properties can face greater penalties for non-compliance. The most severe penalties are handed down only for serious breaches. Landlords with six or more properties could be fined up to $50,000 and as high as $100,000 in hearings.

In the end, a failure to adhere to the Healthy Homes requirements can hit your wallet and result in large fines in addition to still having to meet compliance. Don’t risk your rental property Call us today and make arrangements to have a home assessment done for your rental property.

Healthy homes are important

What is the reason Healthy Homes Compliance so Important?

One in three households rent in New Zealand and Hongoeka, and research shows us that these rental homes are more likely to be colder, older, are not as efficient heating and tend to be of poorer quality than the houses of owners.

Cold, damp and mouldy houses are linked to negative well-being results, specifically for ailments like colds and flu, asthma and cardiovascular diseases. Additionally, those who experience four or more major home quality issues often suffer from poor life satisfaction and lower mental wellbeing.

Unreasonable Gaps & Holes

Draught Stopping Hongoeka

Draughts increase the likelihood of low temperatures inside households. A damp home costs more to heat, resulting in wasted energy and resulting in higher bills.

If a draught could be noticed from gaps that are not adequate or holes the area requirements to be sealed.

What are unreasonable gaps or holes?

If you can feel external air coming in or the air is clear from a gap or hole that is, it’s likely to be a gap or an opening that needs sealing in the way you can. Large gaps and cracks should be sealed permanently. The gaps that exceed 3mm that let air in or out of the house need the sealing. In the case of an open fireplace isn’t in use it can create draughts. This must be sealed off. Landlords and property managers are accountable for making sure such draughts are eliminated as much as possible.

You don’t need to block up intentional gaps or holes which are part of the construction. For example, tiny gaps around windows and doors could be necessary to allow for the movement of the structure as the home warms and cools so that they can still be opened and closed rather than securing. We will test every window and door during an Healthy Homes assessment of your rental property.

A good heating system is important for healthy homes

Heating Hongoeka

Hongoeka rental properties need to have a stable source of heat that can heat the main or largest living room to at least 18 degrees Celsius, even on the winter coldest days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health and mental well-being.

The source of heat requirements to be fixed (i.e. not portable) that is, at minimum 1.5 Kilowatts in heating capacity, and must meet the minimum required heating capacity for the main living room. A Heating Assessment Tool may be used to determine if the installed heater(s) are adequate or if you’ll require to "top-up" with an additional heater. Unflued combustion and open fire heaters such as small portable LPG bottle heaters are not considered to be suitable heating options for The Healthy Homes Standard.

If the heating system you offer is electric heating or heat pump, then it must have the thermostat. This makes the heating more uniform and effective. For most properties, larger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters are necessary. In some instances, like small apartments an electric, fixed heater may be sufficient.

If your living space already has a permanent heating source, such as an air conditioner, it might just need an upgrade to make sure it meets the requirements. Certain types of heaters cannot be used to comply with the standard because they’re inefficient, unaffordable to operate and/or unhealthy to run.

Ventilation Hongoeka

Each liveable space in a rental property has to have at least one openable windows or an exterior door to offer natural ventilation. In addition, humid spaces like kitchens and bathrooms should have an externally vented extractor fan that can get rid of moisture.

The ventilation standard is all about acknowledging the fact that dry air is easier to heat, and that the property that is properly ventilated is less likely to develop damp and mould.

Bedrooms, living spaces, dining rooms, and kitchens are considered liveable spaces. Spaces that connect, such as the hallway aren’t considered liveable , and thus don’t need an opening door or window.

Each window, door or the skylight needs for them to be in a position to open to the outside and remain closed in order to allow for fresh air circulation and ventilation.

The bathrooms in all kitchens as well as any other space in your home that has a bath, shower or cooktop, or any other humidity-generating items will require suitable extractor fans that can be vented to the outdoors. Our Healthy Homes Assessment service will make sure there is sufficient ventilation throughout the living spaces with the right extractor fan in areas of high moisture.

Insulation Hongoeka

The insulation of the ceiling and underfloor is a requirement in all rental homes as of July 1st, 2019. All landlords and property managers have to make sure that the insulation is in line with this new standard. In some instances, old ceiling insulation as well as insulation within the sub floor space may require to be topped up or replaced.

A well-insulated house can reduce condensation and lower the chance of mould and dampness, and will also make much easier for the house to keep warmth.

Insulation needs to meet the R-values that are appropriate for your region.

The "R" refers to thermal resistance and is a gauge of how well the insulation withstands heat flow. The more R-value is higher, the better the insulation.

  • Zone 1 Zone 1 Auckland & Northland - ceiling R 2.9 and underfloor R 1.3
  • Zone 2 – the remainder of North Island except Taupo and the Central Plateau – ceiling R 2.9 underfloor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and all of the South Island – ceiling R 3.3 and underfloor R 1.3

Hongoeka Moisture Ingress & Drainage

Protecting your rental property from dampness isn’t just about the interior of the building it’s also about the outside. You must ensure there is somewhere for rain, surface and underground water to flow, and stop it from coming inside. When it is damp and moisture, it’s usually those things that you aren’t aware of that can become a big problem, causing damages to your investment and harming your tenant’s well-being.

Rental properties should have efficient drainage to eliminate storm water, surface water, and ground water. This includes the proper outfall or runoff. Making sure that water is able to go, and that it can’t linger underneath the buildings is a vital aspect of keeping your property dry.

In addition to the drainage system that will prevent moisture ingress, if your rental is enclosed between your flooring and the ground, a ground water barrier must be put in place when it’s reasonably practicable to install it.

An underground moisture barrier generally a sheet of polythene that is placed over the ground to stop any moisture from the ground from getting into the home. It also helps in preventing from causing damage to the flooring insulation.
