Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied tenancy is signed for a Hongoeka rental property, all Healthy Homes compliance tasks must be completed by the end of 90 days.

Since the 1st July of 2021, once a new, renewed or varied contract is signed on a Hongoeka rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Inability to adhere to one of the Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not included within the new, renewed or revised tenancy contract, there may be an additional fine or infringement fee.

Anyone can request information about the Healthy Homes Standard and how they relate to the property they are living in. If the property manager is unable to provide the information requested within 21 days of having received the inquiry, they can receive an infringement letter and could be fined up to $750.

Furthermore, there’s also a penalty of as much as $900 for landlords and property managers providing a false or incorrect Healthy Homes Compliance Statement or information. The person who is responsible for this fine is the one who is identified on the tenancy contract as the person renting the property and it could be the name of the landlord as well as the company that manages the property.

All information in the Statement of Compliance requirements to be accurate before the tenancy agreement can be signed. It must be updated through the tenancy period as related work is completed.

It’s also important to note that a landlord who own multiple rental properties may receive additional fines for non-compliance. The harshest penalties are reserved only for serious breaches, and landlords with six or more properties could be fined up to $50,000, and even as high as $100,000 in hearings.

Hongoeka Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is compulsory to all Hongoeka and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included with any new, renewed or amended tenancy agreement.

Rental properties in Hongoeka require a reliable heating source that is able to heat the principal or the biggest living space to a minimum of 18 degrees Celsius, even on the most coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

Certain types of heaters cannot be used to meet the standard as they are either costly, not cost-effective to run, and/or unsafe to run.

Ventilation Hongoeka

Every living space in a rental property must include at least one open door or window to offer natural ventilation. Furthermore, moist areas such as kitchens or bathrooms must have a suitable externally vented extractor fan to eliminate moisture.

A ventilation quality is all about acknowledging that dried air can be easier to heat and a well ventilated rental property will be less prone to developing mould and damp.

Bedrooms, living rooms dining rooms, and kitchens are all considered living spaces. Spaces that connect, such as the hallway are not considered living spaces and therefore are not need an opening door or window.

Every window, door or the skylight needs at least to open up to the outside and remain fixed in an open position to allow ventilation and fresh air air flow.

The bathrooms in all kitchens and every other room of your property with shower, bath or cooktop, or any other moisture-producing item will need suitable extractor fans that vent out to the outside. Insulation Hongoeka

Insulation for underfloor and ceilings is a requirement on all rental homes since 1 July 2019. All landlords and property managers must ensure the insulation meets current standard. In some cases, current ceiling insulation, or the insulation of the subfloor space might need to be filled with or replaced.

A house that is well-insulated will reduce the risk of condensation, and decrease the risk of mould and dampness, and will also make much easier for the house to keep the heat.
