Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed for a Hongoeka rental property, all Healthy Homes compliance tasks need to be completed inside of 90 days.

Since the 1st July of 2021, if a new or renewed Tenancy is signed for the Hongoeka rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to adhere to one of the Healthy Homes Standards by the end of the expected timeframe can result in the possibility of a fine up to $7200. Additionally, if the most present Healthy Homes Statement of Compliance is not included within the renewal, new or revised tenancy contract, it could result in an additional penalty or infringement fee.

Hongoeka Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is compulsory for all Hongoeka and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords must keep records of their the compliance with the Healthy Homes Standards that apply or will be applicable throughout the tenancy period of your rental home.

From July 1st 2021

  • Private landlords and property managers should ensure their rental properties comply in accordance with Healthy Homes Standards within 90 days of a new, renewed or varied Tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All households that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draughts increase the likelihood of lower temperatures in houses. A damp home will cost more to heat, resulting in wasted energy and incurring higher costs.

What are the most unreasonable gaps or holes?

If you are able to feel external air getting in, or see an unobstructed draught coming from a gap or hole and you can feel it, it is most likely a gap or crack that requirements sealing in some way. Cracks or gaps with large gaps must be fixed permanently. The gaps that exceed 3mm that let air in or out into your house require to be sealed. For example, if an open fireplace is not in use, it may cause draughts and should be sealed from. Property managers and landlords are responsible for ensuring that draughts from the fireplace are removed in the maximum extent imaginable.

Adequate heaters are important for well-being homes

Heating Hongoeka

Rental properties in Hongoeka need to have a stable source of heating that can heat the main or largest living space to at least 18degC, even on the coldest winter days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

Insulation for underfloor and ceilings has been compulsory for all rent houses from 1 July 2019. All landlords and property managers must ensure that the insulation is up to this new quality.
