Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed on a Hongoeka rental property, all Healthy Homes compliance items have to be done inside of 90 days.

Failure to comply with any of the Healthy Homes Standards by the end of the expected timeframe can result in a fine of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or revised tenancy contract, there may be additional penalties or an infringement fee.

Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the home they reside in. If the property manager fails to supply the necessary information within 21 days from receiving the request, they could be issued an infringement notice and be fined upto $750.

Additionally, there is also a fine of as much as $900 for landlords or property managers providing a false or inaccurate Healthy Homes Compliance Statement or any other information. The person who is liable for this fine is the one who is named on the tenancy agreement as being the person renting the property, so it could be the landlord’s name or the company that manages the property.

All information in the Compliance Statement needs to be current when the tenancy agreement is completed, and must be updated during the entire tenancy, as related work is completed.

It’s crucial to remember that landlords with multiple rental properties may receive more severe penalties for not complying. The most severe penalties are handed down for the most serious breaches. Landlords with more than six properties could be fined up to $50,000, and as much as $100,000 in the case of hearing claims.

Hongoeka Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is compulsory in all Hongoeka and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included with any renewal, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate conformance with each Healthy Homes Standard that apply or will be in force during the tenure of your rental home.

Heating Hongoeka

Hongoeka rental properties must have a fixed heating source that can warm the principal or the biggest living room to at least 18degC, even during the winter coldest days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental outlook.

The heating source requirements to remain fixed (i.e., not portable), at minimum 1.5 kW in heating capacity, and meet the minimum required heating capacity for the main living room. Fires that are open and unflued heaters, such as small portable LPG bottle heaters are not considered to be suitable heating options in the Healthy Homes Standard.

In some instances, an existing insulation on the ceiling or in the subfloor space may need to be topped up or replaced.
