Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied tenancy is signed for a Hongoeka rental property, all Healthy Homes compliance work have to be completed inside of 90 days.

Since the 1st July of 2021, if a new, renewed or varied contract is signed on a Hongoeka rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to meet all of the Healthy Homes Standards inside of the deadlines can result in a fine of up to $7200. Additionally, if a present Healthy Homes Statement of Compliance is not included in an updated, renewed, or revised tenancy agreement, there could be an additional penalty or infringement fee.

Anyone can request information about the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or property manager does not provide the necessary information within 21 days from receiving the request, they will receive an infringement notification and be fined upto $750.

All information in the Statement of Compliance needs to be up-to-date at the time that the tenancy agreement is signed, and ideally it is updated during the entire tenancy, as relevant work gets completed.

It’s also important to keep in mind that a landlord who have multiple rental properties may face greater penalties for non-compliance. The most severe penalties are handed down for the most serious breaches, and landlords with six or more properties could be penalised up to $50,000, or as high as $100,000 in hearings.

When should I need to be in compliance with The Healthy Homes Standards?

Hongoeka Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is required for all Hongoeka and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included in any renewal, new or varied tenancy agreement.
  • Property managers and landlords must keep records of their the conformance to each Healthy Homes Standard that apply or will be applicable to your rental home.

From July 1st 2021

  • Property managers and private landlords must make sure that their rental properties are in compliance with the Healthy Homes Standards within 90 days of any new, renewed , or altered tenancy.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) must meet the Healthy Homes Standard regardless of the date when the tenancy started.

From July 1st 2023

  • All houses let from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental homes have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Hongoeka

Hongoeka rental properties require a reliable source of heat that can heat the living room to at least 18degC, even on the most coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The heating source needs to remain fixed (i.e. not portable) with at minimum 1.5 horsepower in capacity, and must meet the minimum requirement for heat capacity in the living area. The Heating Assessment Tool can be used to determine whether the current permanent heater(s) are sufficient or whether you will require to ‘top up’ with a new heater. Open fires as well as unflued combustion heaters like portable LPG bottle heaters are not considered acceptable heating options under The Healthy Homes Standard.

If the heating system you offer is electric heating (or heat pump), it must be equipped with a thermostat. This will make the heating more reliable and effective. Insulation Hongoeka

Underfloor and ceiling insulation is mandatory to all rental houses since July 1, 2019. All landlords and property managers are required to ensure that the insulation is up to current quality. In certain situations, the current ceiling insulation, or the insulation of the subfloor space may require to be topped up or replaced.
