Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed tenancy is signed on a Cannons Creek rental property, all Healthy Homes compliance items have to be taken care of by the end of 90 days.

From the 1st of July in 2021, when a new, renewed or varied Tenancy is signed for the Cannons Creek rental property, all Healthy Homes compliance work must be done by the end of 90 days.

If the landlord or property manager is unable to provide the necessary information within 21 days from receiving the request, they may receive an infringement letter and be fined upto $750.

Furthermore, there’s an additional fine of approximately $900 for landlords or property managers that provide false or misleading Healthy Homes Statement of Compliance or any other information. The person who is liable for this fine is the person who is named on the lease agreement as being the person renting the property, so it could be the name of the landlord or the company that manages the property.

All information in the Statement of Compliance needs to be correct when the tenancy contract is signed. It should be maintained throughout the duration of the tenancy when any associated work has been completed.

It’s also crucial to keep in mind that landlords with multiple rental properties may receive more severe penalties for not complying. The harshest penalties are handed down for serious violations, and landlords who own at least six rental properties could receive fines of up to $50,000, or as high as $100,000 in hearings.

Tenancies established beginning on 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is mandatory for all Cannons Creek and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords are required to keep records that prove conformance with all Healthy Homes Standard that apply or will be applied during the tenure of an apartment rental.
